Buyer and seller terms

Who operates this service

Bivetica Cars is operated by Jonathan Mills, sole trader trading as Bivetica, 28–30 High Street, Nettlebed, Henley-on-Thames, RG9 5DD. Contact [email protected] or 01491 712012 for support, complaints or cancellation requests.

The vehicle sale

We provide an advertising and enquiry service. The named seller sells the vehicle, not Bivetica. Buyers and sellers agree the vehicle price, any deposit, payment, delivery or collection directly. We do not collect or hold vehicle purchase money, provide escrow, or offer vehicle payment protection. A listing, MOT lookup or paid promotion is not our endorsement or a guarantee of a vehicle, its condition, ownership or the seller.

Buyers should check identity, ownership documents, specification, condition and payment arrangements before committing. Do not treat an advert or an MOT result as a substitute for inspecting the car. Rights when buying from a trader differ from those when buying privately; a trader must not advertise as a private seller.

Seller responsibilities

You must be entitled to sell the car and use the photographs you upload. Keep the price, mileage, condition, specification, availability and seller status accurate. Check automatically supplied data and disclose known material faults or modifications. Do not upload identity documents, payment details or unrelated personal information. Remove or mark the advert sold when appropriate. We may restrict misleading, fraudulent, unlawful or abusive adverts or accounts and investigate reports.

Free adverts and managing your listing

Private sellers may have up to three live standard adverts, each running for 60 days. Email verification is required before publishing. Saved edits to a live advert take effect immediately and keep its existing link and expiry. Withdrawal takes it offline and returns it to drafts. Deletion removes it from your account and public browsing; it is not an immediate erasure of all underlying records or photos. See our privacy notice.

Optional featuring and payments to Bivetica

Featuring is a separate purchase of advertising placement for the displayed price and fixed duration. It does not guarantee enquiries or a sale. It is not payment for the vehicle. The available payment methods and total payable are shown before payment through Bivetica Invoice. Where offered, GoCardless processes Direct Debit payments for Bivetica’s services.

A promotion starts after verified payment confirmation, which may take several working days for Direct Debit. Returning from a payment page alone does not activate it. Buying a fixed-term promotion does not by itself enrol you in an automatically renewing subscription. Withdrawing, deleting or marking the advert sold ends its current promotion and does not automatically issue a refund.

Cancellation, refunds and service problems

If you buy featuring as a consumer, you normally have 14 days from making the service contract to cancel. Contact [email protected] with your advert link, order reference and the email used to buy. You can use the cancellation wording below or make any clear cancellation request. We do not treat payment alone as consent to waive cancellation rights. Where the law allows a charge for service already supplied following your express request, any deduction must be proportionate. This does not limit your rights if a service is faulty, not supplied or misdescribed.

To cancel, you may send: “I wish to cancel my Bivetica Cars featuring order. Order reference: __. Ordered on: __. Name and address: __. Account email: __. Date: __.” No signature is needed for an email request. Cancellation refunds due under consumer law are made within the applicable legal deadline, normally within 14 days of your cancellation notice, using the original payment method unless agreed otherwise.

Contact us if payment is taken but the purchased promotion is not provided. Cancelling a bank mandate is separate from cancelling an order; tell us about both so we can investigate. Your applicable Direct Debit Guarantee rights remain separate from whether you owe a valid charge.

Our responsibilities and your rights

We remain responsible for providing our own service with reasonable care and skill. These terms do not exclude responsibility for our fraud, death or personal injury caused by our negligence, or any responsibility that cannot lawfully be excluded. Nothing here removes your statutory consumer rights. Our role in a vehicle transaction does not remove responsibility for our own actions.

Concerns and changes

Report a suspicious advert to [email protected] with its link and the reason for concern. We can review the advert and investigate platform misuse; this is not a promise to adjudicate or reimburse a vehicle transaction. We date changes to these terms. Changes do not retrospectively remove rights relating to an existing paid order.
